A woman in Barabanki has been jailed for 7.5 years and fined ₹2.01 lakh for filing a false gang-rape and SC/ST case. The court emphasized delayed compensation to deter misuse.
Mumbai | In a landmark decision aimed at curbing the misuse of sensitive laws, a woman from Barabanki, Uttar Pradesh, has been sentenced to 7.5 years in prison and fined ₹2.01 lakh for filing a false gang rape and SC-ST case against two men.
The case dates back to 2021, when the woman, a resident of Zaidpur, lodged a complaint at the Zaidpur police station, accusing two individuals — Rajesh and Bhupendra — of gang rape and life-threatening intimidation. She also invoked provisions of the SC/ST Atrocities Act, making the matter highly sensitive.
The matter was later transferred to Lucknow for detailed investigation due to the involvement of the SC/ST Act. The probe was conducted by the Circle Officer of Bakshi Ka Talab (BKT).
However, during the investigation, it became evident that the allegations were fabricated with the intention of falsely implicating the accused. As a result, both Rajesh and Bhupendra were given a clean chit, and the tables turned on the complainant. Special Judge Vivekanand Sharan Tripathi delivered the judgment, holding the woman guilty of misusing the law and filing a false case. She was sentenced to seven and a half years in jail and directed to pay ₹2.01 lakh as fine.
Tragically, Bhupendra passed away during the course of the trial. The court has ordered that a portion of the fine should be given to his family as compensation for the mental trauma and defamation they endured.Importantly, the judge made a noteworthy observation during sentencing:
“The immediate payment of government compensation without proper investigation is encouraging a trend of false accusations. This must stop. Compensation should only be disbursed after the filing of a charge sheet.”
