Emphasizing that “illegality is essentially incurable,” the Bombay High Court clearly said recently rejecting the writ suit submitted by Aaryans World School, Bhilarewadi, contesting the demolition order issued by the Pune Metropolitan Regional Development Authority (PMRDA). Nobody is above the law.

Pune | May 16, 2025: Before PMRDA was established, the school – which educates about 2,000 pupils from Classes 1 through 10 – built its facility depending just on a No Objection Certificate (NOC) provided by the Gram Panchayat in 2007. The court noted, though, that a Gram Panchayat does not have the power to approve building plans and that the school neglected to get authorization from the relevant authority, who ought to be the Collector.
Underlining the more general problem of illegal building based on unapproved NOCs produced by local authorities, justices Kamal Khata and A.S. Gadkari attacked the institution for neglecting the necessary legal permissions. The bench ordered the demolition to start fifteen days after the April 17, 2025 initial plan.The court also urged the state to act forcefully against the Gram Panchayat and the Sarpanch in charge of publishing the illegal NOC, thereby guiding the submission of a compliance affidavit by November 14 detailing the actions followed.
Concerned about the increasing use of educational institutions as fronts for illicit building, the judges said this tendency not only compromises respect for the law but also compromises the integrity of urban planning. They pointed out how some people use legal gaps or plea illiteracy to win sympathy, therefore compromising fair government.
Milind Ladge, Managing Director of Aaryans World School, defended the institution’s policies by saying, “We are law-abiding people. Our management starts with the legal papers. Different land laws applied at first; today we follow the present rules. We sought a stay on the verdict of the High Court and have appealed to the Supreme Court, where we have gotten a stay order.
This case reminds us of the need of rigorous adherence to construction rules, particularly in the educational sector, where compliance guarantees not only legal operation but also protects students’s futures. The court’s strong posture emphasizes the importance of open government and responsibility at all local administrative levels.
