Pune, April 19, 2025 — This afternoon, In a significant development,l in Deenanth Mangeshkar Case, Pune Police have registered a First Information Report (FIR) against Dr. Sushrut Ghaisas, a senior medical practitioner at Deenanath Mangeshkar Hospital, under Section 106(1) of the recently implemented Bharatiya Nyaya Sanhita (BNS), 2023. The section pertains to “causing death by negligence, not amounting to culpable homicide.”

The case involves allegations of medical negligence that reportedly led to the death of a patient during a procedure at the reputed hospital. While full details of the incident are yet to be officially released, sources indicate that the police acted based on a formal complaint filed by the deceased patient’s family.

Section 106(1) of the BNS replaces the older Section 304A of the Indian Penal Code and specifically outlines that if a registered medical practitioner causes death through a negligent act during a medical procedure, the punishment may extend to two years imprisonment along with a fine. In cases of general negligence not involving medical professionals, the maximum term can extend up to five years.

Legal experts note that the new provision strikes a balance between accountability and recognition of the complexities in the medical field. “While the law provides some protection to doctors performing high-risk procedures, it does not offer blanket immunity,” said a Law Professional .

The case has sparked discussions across the city’s medical and legal communities. Deenanath Mangeshkar Hospital, widely regarded for its medical services, has yet to release an official statement regarding the allegations against Dr. Ghaisas.

The FIR marks one of the first known instances in Pune where the new BNS provision has been invoked in a case involving a medical professional. Further investigation is underway, and Dr. Ghaisas has not yet been arrested as of the time of writing.

The incident raises important questions about medical accountability and the scope of legal protection for healthcare workers under India’s reformed criminal justice code.
