
After Six Years of Delay, Maharashtra Cooperatives Department Releases Housing Society Rules
After six years, Maharashtra announces draft regulations for housing societies. The rules, covering member registration, fees, and maintenance, aim to bring transparency and consistency. Feedback due by May 16.
Pune, April 24, 2025: In a long-awaited move, the Maharashtra Cooperatives Department has finally published the draft regulations for housing societies under the Maharashtra Cooperative Societies Act, 1961. The announcement came after public criticism from Chief Minister Devendra Fadnavis, who voiced his displeasure at the prolonged delay during a housing societies convention in Pune last month.
The Maharashtra Cooperative Societies Act was amended in 2019 to include a specific section for cooperative housing societies, a much-needed update as housing societies did not previously have clear provisions under the Act. An ordinance was issued in the same year, but the draft regulations for housing societies were never finalized. One of the primary reasons for the delay was the lack of timely translation of the draft into Marathi by the Directorate of Languages, which prevented the rules from being implemented.
During the Pune convention, Fadnavis emphasized the importance of these rules, expressing regret that, despite the legal amendment in 2019, the regulations had not been released for so long. He assured that the rules would be published within 10 to 12 days.
In response, the Cooperatives Department has now issued the draft regulations, which outline procedures for member registration, membership fees, bank accounts, maintenance responsibilities, and arrears recovery, among other aspects. These provisions aim to bring uniformity, transparency, and consistency to the management of housing societies across the state.
The Cooperatives Department has set a deadline of May 16 for housing societies and their members to submit objections or suggestions on the proposed regulations. These rules are expected to resolve long-standing issues related to housing society governance, providing clearer guidelines for better administration and smoother operations.
