Pune Court Slams PMC for Negligence in Boy’s Tragic Drowning

A 12-year-old’s death in an uncovered water tank has led to a court ordering the Pune Municipal Corporation to pay Rs 11 lakh to his grieving family. 

In a heart-wrenching tragedy, 12-year-old Tushar Babu Ramoshi, from a family of daily-wage laborers in Kasba Peth, lost his life on April 9, 2018, after drowning in an uncovered water tank near a public toilet. The boy had gone to use the facility in the evening, but when he didn’t return, his parents’ desperate search led them to find him unconscious in the tank. Despite being rushed to the hospital, Tushar was declared dead due to asphyxiation.

The Pune Civil Court, in a landmark ruling, held the Pune Municipal Corporation (PMC) accountable for gross negligence, emphasizing the absence of basic safety measures at the site. The family’s legal team argued that the tank, located next to a heavily used public toilet, was a clear hazard, especially for children, due to its poor maintenance and lack of a cover.

The PMC’s defense, which attempted to shift blame to the family and claimed the tank was solely for toilet cleaning, was dismissed by the court. The judge ruled that the civic body had a fundamental duty to maintain safe public infrastructure, and its failure directly caused the tragedy. The court ordered PMC to pay Rs 11 lakh in compensation to Tushar’s family, with 6% annual interest from the date the case was filed, acknowledging that no amount could ease their loss.

This ruling has sparked renewed calls for accountability in maintaining public facilities, as the community mourns a preventable loss and demands safer infrastructure to protect vulnerable residents.
