Prakash Ambedkar calls Nagpur High Court order on local body elections legally flawed, says courts cannot interfere once polls begin; urges Chief Justice to ensure counting resumes without delay.


Pune | December 04, 2025: National President of Vanchit Bahujan Aghadi, Adv. Prakash Ambedkar, strongly criticized the Nagpur bench of the Bombay High Court for intervening in the local body election process. Speaking at a press conference, he described the court’s order to suspend voting and counting as legally invalid and beyond jurisdiction.

Ambedkar emphasized that the State Election Commission has set December 10, 2025, as the deadline to declare election results in the gazette. He stated that once the electoral process begins, no court has the authority to interfere. He cited Article 243(O) of the Constitution, which explicitly prevents judicial intervention until elections are concluded.

He also questioned the basis of the High Court’s reliance on a District Sessions Court judgment, noting that it was not formally delivered. “This flawed order has created confusion and risks undermining the local body elections,” Ambedkar said, adding that the petition to postpone counting was reportedly filed by a candidate from the Bharatiya Janata Party.

Ambedkar urged the Chief Justice of the Bombay High Court to take suo motu cognizance of the matter and direct the resumption of vote counting. He insisted political parties should be able to participate without fear of legal consequences and stressed that the Election Commission is committed to announcing results by the prescribed deadline.

In addition, he raised concerns over EVM integrity, questioning whether chips are manufactured in India or abroad and highlighting allegations of tampering over the past two decades. Ambedkar also pointed out a shortage of EVM machines and VVPATs, which necessitated elections being conducted in two phases.
