Pune PMC Serves Notice to Prithvi Proximus in Hadapsar Over Flats Occupied Without OC

Pune Municipal Corporation issues notice to Prithvi Proximus project in Hadapsar for allowing residents to occupy flats without the required Occupancy Certificate, seeking explanations from the developer.
Pune|February 1, 2026: The Pune Municipal Corporation (PMC) has taken action against the Prithvi Proximus residential project in Hadapsar after reports emerged that residents had moved into flats without obtaining the legally mandated Occupancy Certificate (OC). On February 1, PMC officials issued a formal notice to the developers, asking for a detailed explanation regarding the unauthorised use of the building.
The notice follows a complaint that flagged the absence of both a Completion Certificate and the Occupancy Certificate, despite residents already occupying the premises. Civic authorities have emphasized that handing over flats without these approvals violates municipal regulations.
The project, located on Sadesatra Nali in Hadapsar, is developed by Prithvi Edifice Pvt. Ltd. on land owned by Abhay Pandharinath Kele. It is registered under MahaRERA Registration No. P52100021774.
According to the complaint lodged by Vinayak Joshi on January 23, 2026, several flats were being used without the proper approvals, raising concerns about legal compliance and residents’ safety.
PMC’s notice requires the developer to clarify:
- Why the flats were occupied without an OC,
- Who authorized the handover of flats, and
- Why action under the Maharashtra Municipal Corporation Act should not be taken.
Officials have warned that failure to respond adequately could lead to legal proceedings and penalties. The municipal body reiterated that an Occupancy Certificate is essential before residents can legally move in, and non-compliance is considered a violation of civic norms.
This move underlines PMC’s ongoing efforts to enforce building regulations and ensure safety and legality in Pune’s rapidly expanding residential projects.
