Pune| February 16, 2026: Jaiswal, represented by Advocate Sudhir Shivaji Potale, claimed that he was detained for more than 24 hours without being produced before a magistrate, in violation of Article 21 of the Constitution. According to the defence, he was picked up from Hotel Vidya Residency, Bhagalpur, Shivaji Path, Choti Khanjarpur, Jagdishpur, Bihar, at 11:30 am on January 25, 2026, but was produced in court only at 2:19 pm on January 26, 2026.

The accused faces charges including criminal breach of trust, cheating, and offences involving larger amounts, as well as common intention under the Bharatiya Nyaya Sanhita (BNS). However, the current proceedings focused on the legality of his arrest and detention, rather than the criminal charges themselves.

During the hearing, the defence highlighted discrepancies in police records, including conflicting arrest times of 8 am and 11 am on January 26 and inconsistent arrest locations. The counsel argued that these inconsistencies could indicate manipulation of official records to cover up illegal detention.
The magistrate observed that the core issue is procedural legality. The court stressed that arrest is a legal process, and any violation of constitutional safeguards or statutory requirements cannot be ignored. Bail was granted to Jaiswal, while the matter remains under further judicial scrutiny, including a review of arrest memos, transit details, and the case diary.

This case highlights the importance of strict compliance with procedural safeguards, especially in inter-state arrests, and reinforces the judiciary’s role in protecting personal liberty.
