Gujarat High Court Grants Parole to Life-Imprisoned Couple for IVF Treatment

In a rare and compassionate ruling, the Gujarat High Court has granted parole to a couple serving a life sentence, allowing them to undergo IVF treatment. The couple, Jayendra Damor and Sejal Baria, were convicted in a 2009–2010 murder case in Godhra district and have been behind bars for more than 15 years.
Gujarat | October 31, 2025:The couple approached the court seeking permission for temporary release, stating that they wished to start a family through In Vitro Fertilization (IVF). Their plea argued that the right to parenthood is a fundamental human right, regardless of their imprisonment. After reviewing their request, Justice H. D. Suthar approved their parole until November 2, 2025, directing them to return to jail immediately after the period ends. The court made it clear that no further extension would be granted under any circumstances.
Legal experts and social activists have described this as a progressive humanitarian decision, noting that it reflects sensitivity toward reproductive rights, even for convicted individuals. The judgment underscores the idea that while punishment serves justice, it should not completely strip a person of basic human dignity and life choices.
The High Court also instructed prison authorities to ensure that the couple’s parole period is strictly monitored. Medical documentation related to the IVF procedure will be verified, and all safety and legal protocols must be followed.
The case has drawn widespread attention, opening discussions about the balance between justice, rehabilitation, and human rights within the prison system. For many, the decision sets a precedent that could shape how Indian courts approach similar humanitarian petitions in the future.
