Strict POSH Compliance Now Mandatory Across All Sectors, Says WCD Commissioner Nayana Gunde

Women & Child Development Commissioner Nayana Gunde has ordered all government and private employers — including offices, schools and institutions — to enforce the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Posh Act, 2013. Under the order by Nayana Gunde, every establishment with ten or more employees must form a functional Internal Complaints Committee (ICC). This includes offices, hospitals, educational institutions, industries, corporations and even service providers.

The directive issues a stern warning: failure to comply may result in a fine up to ₹50,000 under Section 26 of the POSH Act. Repeated violations could lead to increased penalties or cancellation of the organisation’s licence.

Gunde has also instructed that details of the ICC — including members and contact information — be uploaded on the central SHe-Box portal, making institutions’ compliance traceable.

This move follows growing concern over gaps in earlier practice: while many organisations nominally formed committees, they often remained non-functional or lacked awareness on complaint procedures, training and redressal mechanisms.

The directive is likely to impact businesses, educational institutions and offices across Maharashtra, including Pune — where complying with POSH norms will require swift administrative action. Employers will need to proactively review policies, form or reconstitute ICCs, and ensure clear complaint redressal and awareness systems.

Civil-society groups and women-safety advocates have welcomed the move, noting that effective enforcement of POSH rules is essential to ensure safe and respectful workplaces for women.
