High Court Halts Excise Crackdown, Orders Immediate Reopening of 2BHK Diner & Key Club in Pune
Bombay High Court stays suspension of liquor licence of Pune’s 2BHK Diner & Key Club, orders immediate de-sealing, citing lack of show-cause notice and hearing.
Pune: The Bombay High Court has stayed the suspension of the liquor licence of Pune’s well-known 2BHK Diner & Key Club and directed the authorities to immediately de-seal the premises, clearing the way for the establishment to reopen.The court observed that the State Excise Department had failed to follow mandatory legal procedure before taking punitive action. It noted that issuing a prior show-cause notice and granting a reasonable opportunity of hearing are compulsory before suspending or cancelling any licence.
The High Court stated that failure to comply with due process makes such orders legally unsustainable and liable to be stayed.
The relief was granted in a writ petition filed by Dr. Heramb Shelke, owner of the establishment. The suspension order had led to a proposed shutdown for 15 days.
Advocate Pralhad Paranjape, appearing for Dr. Shelke, argued that the excise department’s action was arbitrary and high-handed. The court accepted the submissions and stayed the suspension order.
“Law and order prevail,” Dr. Shelke said after the order.
He thanked the judiciary for granting relief and expressed gratitude to patrons who supported the establishment during the closure.
