New Delhi | 26 March, 2026: In a landmark judgment favouring farmers, the Supreme Court has ruled that authorities cannot reduce or deny compensation for acquired land by citing financial constraints. The court emphasized that the constitutional guarantee of fair compensation cannot be compromised under any circumstances.

A bench comprising Chief Justice Surya Kant and Justice Ujjal Bhuyan dismissed a review petition filed by the National Highways Authority of India (NHAI), which had challenged an earlier ruling on compensation payments.

The case stems from a 2025 judgment in which the apex court had directed that farmers whose land was acquired should be paid compensation along with 9 percent interest. The NHAI argued that implementing the ruling retrospectively would impose a financial burden of nearly ₹29,000 crore on the authority.

Rejecting this contention, the court clarified that the magnitude of financial liability cannot be grounds for revisiting or diluting a judicial decision. It upheld that affected landowners are entitled to fair compensation as per legal provisions.

The court also struck down the 5 percent interest cap under the NHAI Act, affirming the applicability of higher interest provisions under land acquisition laws.

However, the benefit of enhanced compensation and interest will apply only to cases that have been pending or under legal process since 2008.

Additionally, the bench reiterated that Section 3-J of the NHAI Act violates Article 14 of the Constitution, which guarantees the right to equality.
