The Mumbai High Court has ruled Vicky Kamble’s arrest illegal and ordered his immediate release, citing violations of due process and lack of valid evidence.

Mumbai | October 15, 2025 — The Mumbai High Court has ordered the immediate release of Vicky Kamble, declaring his arrest unlawful. The court ruled that the arresting authorities had violated legal procedures and deprived Kamble of his fundamental rights under Article 21 of the Constitution, which guarantees the right to life and personal liberty.

The bench noted that the police had failed to provide valid reasons for Kamble’s detention and did not follow the mandated process for informing him of the grounds of arrest. No substantial evidence was presented to justify the custody, leading the court to conclude that the arrest was arbitrary and illegal.

The High Court emphasized that personal liberty is a core constitutional right and any deprivation of it must strictly adhere to statutory and constitutional provisions. The court directed the authorities to release Kamble immediately unless he is detained on other lawful grounds.

Legal experts and civil rights advocates have hailed the verdict as a landmark decision reinforcing the importance of due process and accountability in law enforcement. They stressed that such rulings serve as a deterrent against arbitrary arrests and misuse of police power.

This judgment has sparked discussions on police accountability, procedural safeguards, and the need for systemic reforms in Maharashtra’s law enforcement practices. It reinforces the judiciary’s role as a guardian of individual rights and a check on executive authority, highlighting the importance of legal compliance in criminal procedures.

Kamble’s legal team welcomed the decision, stating that it upholds constitutional protections and serves as a reminder that fundamental rights cannot be ignored. The High Court’s ruling is seen as an important precedent for future cases involving unlawful detentions and police misconduct in Maharashtra.
