Pune Tribunal Awards ₹12.79 Lakh Compensation to Family of Labourer in 2019 Road Accident Case
A Pune tribunal has granted ₹12.79 lakh compensation to the family of a labourer who d!ed in a 2019 road accident, holding the driver responsible and applying the “pay and recover” principle.
March 12, 2026 | Pune :he Motor Accident Claims Tribunal in Pune has awarded compensation of ₹12.79 lakh to the family of a labourer who d!ed in a road accident in 2019, holding the vehicle driver responsible for negligent driving. The tribunal also invoked the legal principle of “pay and recover,” directing the insurer to first compensate the family before recovering the amount from the vehicle owner if insurance policy violations are established.
The victim, Nandkumar Pandurang Dhobale, a 55-year-old resident of Wakad, was travelling to a road construction site on February 24, 2019. He was standing in the rear portion of a TATA Xenon vehicle transporting tar drums along the Kamshet–Pawana Nagar Road when a sudden jerk allegedly caused by rash driving made him fall from the moving vehicle. He suffered severe head injuries and later d!ed. Following the incident, the victim’s wife and three children filed a claim seeking compensation for the loss of their primary earning member. After reviewing the evidence and circumstances of the accident, the tribunal held the driver responsible for negligent driving.
The tribunal awarded around ₹10.89 lakh towards loss of income and ₹1.60 lakh as consortium compensation for the wife and children. An additional ₹30,000 was granted for funeral expenses and loss of estate. The compensation amount will carry an annual interest of 7 percent from July 5, 2019. As part of the compensation distribution, ₹3 lakh will be placed in a five-year fixed deposit in the widow’s name, while ₹1.5 lakh each will be paid to the couple’s three children. The remaining amount, along with accrued interest, will be transferred directly to the widow’s bank account, providing financial support to the family
