The pace of recovering outstanding real estate compensation from defaulting builders has slowed significantly across Maharashtra, leaving thousands of homebuyers in prolonged anticipation after a meager increase in collections

June 1, 2026 | Pune: Despite targeted interventions by the state government to fast-track financial recoveries for aggrieved homebuyers, administrative data reveals that the regulatory machinery has hit a massive bottleneck. Over the last five months, the specialized revenue extraction framework managed to collect only an additional 100 million rupees statewide. Statistics from the Maharashtra Real Estate Regulatory Authority indicate that the total volume of unresolved financial defaults, which stood at a staggering 2.70 billion rupees in December 2025, has escalated to approximately 2.80 billion rupees due to persistent execution delays.

The slow progress comes amid strategic administrative deployments, where the state appointed dedicated recovery officers to high-burden zones, including Mumbai City, Mumbai Suburban, Pune, Thane, and Raigad. Mumbai Suburban remains the worst-hit region with an accumulated 3.52 billion rupees in outstanding builder defaults, against which a mere 120 million rupees has been successfully retrieved. Meanwhile, Pune district authorities have recovered 470 million rupees against total pending warrants worth 1.95 billion rupees, while processing speeds in Thane, Raigad, and Palghar remain similarly sluggish.

Under Section 40(1) of the Real Estate Regulation and Development Act, the regulatory authority issues official warrants authorizing district collectors to attach bank accounts, freeze corporate assets, and execute public auctions against non-compliant developers who default on mandatory refunds, interest payments, or statutory compensation. However, bureaucratic inertia at the field level has severely hampered the actual implementation of these aggressive fiscal measures.

Frustrated homebuyers, many of whom have spent years navigating legal battles, continue to wait indefinitely for actual monetary disbursements despite possessing favorable regulatory verdicts. Furthermore, consumer protection forums express rising concern that the impending national census and structural local governance tasks will divert administrative resources, pushing these critical recovery operations further down the regulatory priority list and exacerbating the financial distress of property investors.
