Pune Court Orders Watch Retail Firm and Partners to Repay ₹10.23 Lakh After Cheque Bounce
A Pune civil court has directed a watch retail firm and its partners to repay ₹10.23 lakh with 10% annual interest after a cheque issued towards outstanding business dues was dishonoured due to insufficient funds.

A Pune civil court has ordered a city-based watch retail firm and its partners to repay more than ₹10.23 lakh along with 10% annual interest and litigation costs after a cheque issued towards payment for watches and accessories was returned unpaid because of insufficient funds.
The order was passed by S. S. Kadam in a commercial recovery suit filed by Infinity Enterprises against M/s New Time On and its partners, Anand Prabhakar Thorat, Sanjay Metkari, Prabhakar Thorat and Sudharshan Thite.
According to the court proceedings, the dispute arose after the retailer allegedly failed to clear outstanding dues for the supply of branded watches and accessories. To settle the liability, a cheque was issued in favour of the distributor. However, when presented for encashment, the cheque was dishonoured by the bank with the endorsement “Funds Insufficient.”
The plaintiff placed on record the dishonoured cheque, the bank’s return memo and other supporting documents to establish the claim. The court also observed that the defendants did not effectively contest the proceedings or produce material capable of rebutting the evidence submitted by the plaintiff.
After examining the available records, the court concluded that the distributor had successfully proved its claim and held the firm as well as all its partners jointly liable for the outstanding amount of ₹10,23,713.
While the plaintiff had sought interest at the rate of 24% per annum, the court declined to grant the higher rate, noting that no contractual agreement existed between the parties to justify such interest. Instead, the court directed the defendants to pay interest at 10% per annum from the date of filing of the commercial suit until the entire amount is recovered, in addition to litigation costs.
